Terms and Conditions of Sale
Please read the following terms and conditions carefully before placing your order. Customers are advised to retain a copy of these terms for future reference.
1. Clarification of Terms and Contract Format
1.1 These terms govern the customer’s use of products and services provided by Top One (referred to as “the Supplier”). These conditions apply to all sales made by the Supplier unless explicitly agreed otherwise in writing by both parties.
1.2 No valid contract exists between you (the customer) and the Supplier until your order has been dispatched and full payment has been received and cleared.
1.3 Upon receiving your order request, an order confirmation email will be sent to your designated email account. This email serves only as an acknowledgment of your purchase request and does not constitute a binding contract.
1.4 These Terms and Conditions may be amended or updated without prior notice. However, the Supplier is responsible for ensuring that the latest version is easily accessible to customers.
1.5 The customer is responsible for all payments for goods and services ordered under their account, including unauthorized use by third parties, unless such use is proven to be due to the Supplier’s negligence.
By placing an order, you confirm that you are 18 years of age or older. The customer must ensure that no one else uses their account to purchase products. A person aged 18 or above (with valid identification) must be present to accept delivery; otherwise, delivery will be rescheduled.
2. Product Pricing and Information
2.1 Products ordered will be as described and priced at the time of order submission. While the Supplier makes every effort to ensure accuracy, the Supplier reserves the right to cancel orders due to pricing errors, market fluctuations, or typographical/photographical mistakes before a legal contract is formed (as outlined in Section 1).
2.2 All orders are subject to product availability. If goods are unavailable, the Supplier will notify you promptly.
2.3 The Supplier strives to ensure that product prices, details, and sizes on the website are up to date. Prices may change without prior notice, and all orders are subject to the Supplier’s acceptance and stock availability.
2.4 The Supplier will make every effort to ensure products displayed on the website are in stock. If a product becomes unavailable, the Supplier may offer an alternative product of similar value and style.
2.5 All orders are subject to final availability confirmation. The Supplier reserves the right to reject orders if products or services are unavailable. If any items cannot be fulfilled, you will be notified by phone or email before the requested delivery date.
2.6 The Supplier does not guarantee the accuracy of product reviews on the website. All content and ratings are provided “as is,” and customers must use their own judgment when making purchases.
3. Registration
3.1 Registration is required before placing any order on this website. During registration:
- 3.1.1 You must provide accurate, complete, and up-to-date information.
- 3.1.2 You must safeguard your username and password.
- 3.1.3 You authorize the Supplier to assume that anyone using your login credentials is either you or authorized by you.
3.2 The Supplier reserves the right to refuse or terminate any customer’s registration at its sole discretion.
3.3 You must inform the Supplier immediately of any changes to your provided information to ensure effective communication.
4. Payment
4.1 All product prices are listed in Hong Kong dollars.
4.2 Payment for goods and delivery charges can be made using any method displayed on the Supplier’s website at the time of order placement. Payment must be completed before the order is dispatched.
4.3 Orders are dispatched and invoiced after payment clearance.
4.4 The Supplier reserves the right to change payment terms for any order without prior notice.
4.5 The Supplier is not liable for any loss or damage (including indirect or consequential losses) arising from online payment issues, including but not limited to:
- Failures, delays, or interruptions in payment gateway transmissions.
- Errors or omissions in payment gateway information.
- Breakdowns or malfunctions of payment gateways.
5. Delivery
5.1 Goods will be delivered to the address provided during order placement. The Supplier currently does not operate outside Hong Kong, and orders for international delivery will be canceled.
5.2 Orders placed before 12:00 PM on a working day will be processed within 3 working days, subject to stock availability and no additional security checks. (Working days exclude Sundays and public holidays.)
5.3 If delivery cannot be made due to reasons within the Supplier’s control, you will be informed promptly, and any delivery charges paid will be refunded.
5.4 If you deliberately fail to accept delivery (for reasons not attributable to the Supplier), the Supplier may:
- Store the goods and charge you for storage and redelivery costs; or
- Treat the situation as a contract cancellation.
5.5 If you cancel your contract, the Supplier will refund or re-credit you within 30 days for any amounts paid.
5.6 The Supplier will make every effort to deliver goods promptly but is not liable for delays beyond its control. You will be informed of any delays as soon as possible.
5.7 Goods may be delivered earlier than the estimated delivery date. Delivery estimates may be updated based on the latest information.
5.8 Delivery times are provided as a date range and refer to working days (excluding Sundays and public holidays).
5.9 Delivery services are suspended during Typhoon Signal No. 8 or above or Black Rainstorm Warnings. Customers will be contacted to reschedule delivery.
5.10 The Supplier reserves the right to charge an additional fee if the recipient is unavailable at the nominated delivery time.
5.11 Customers must notify the Supplier immediately of any changes to their delivery address.
5.12 Customers must arrange for an authorized person to accept and sign for the package on the estimated delivery date.
5.13 Packages will not be left at unattended locations.
5.14 The Supplier reserves the right to decline delivery to any customer at its sole discretion.
6. Damaged Products
Upon delivery, you may be asked to sign for the goods received in good condition. It is your responsibility to inspect the goods at the time of delivery. Failure to do so may affect any claims for loss or damage.
For refund or return claims, please contact the Supplier.
7. Risk and Title
7.1 Risk of the goods transfers to you upon delivery.
7.2 Ownership of the goods remains with the Supplier until full payment (in cash or cleared funds) is received for:
- The goods; and
- Any other amounts owed to the Supplier.
7.3 The Supplier reserves the right to recover payment if ownership has not passed to you.
8. Right to Cancel
8.1 You may cancel the contract within 14 days of receiving the goods.
8.2 To cancel, you must provide written notice via letter or the Returns section of the website, detailing the goods and delivery information. Phone notifications are not sufficient.
8.3 If you cancel after receiving the goods, you are responsible for returning them at your own cost, except in cases of faulty goods, where return shipping costs will be covered by the Supplier.
8.4 Once cancellation is notified, the Supplier will refund or re-credit you within 30 days for any amounts paid.
8.5 If goods are not returned as required, the Supplier may charge recovery costs.
8.6 You cannot cancel orders for unsealed consumables.
9. Limitation of Liability
9.1 The Supplier’s liability is limited to losses reasonably foreseeable at the time of contract formation.
9.2 The Supplier is not liable for indirect or consequential losses (e.g., loss of profit, business, or goodwill).
9.3 The Supplier is not liable for delays or failures caused by events beyond its control (e.g., natural disasters, government intervention, strikes).
10. User Obligations
10.1 By accessing the Supplier’s website, you agree:
- Not to infringe copyright or use the site for illegal, improper, obscene, or defamatory purposes.
- To ensure all provided information is accurate.
- To comply with the Supplier’s disclaimers, liability limitations, and data policies.
11. Third-Party Advertisers
11.1 Your dealings with third-party advertisers on the Supplier’s website are solely between you and the advertiser. The Supplier is not responsible for any resulting loss or damage.
12. Data Protection
12.1 The Supplier takes reasonable precautions to secure your information but is not liable for unauthorized access unless due to its negligence.
13. Service Modifications
13.1 The Supplier reserves the right to modify or discontinue services (or any part thereof) at any time without liability to you or third parties.
14. Indemnity
14.1 You agree to indemnify the Supplier against all losses, damages, claims, and expenses arising from your breach of these terms or negligence.
15. Governing Law
15.1 These terms are governed by Hong Kong law. If any part of these terms is unenforceable, the remaining terms remain valid. The English version prevails in case of discrepancies with the Chinese version.
